About these terms
These terms apply when you sign up to a Stay Found Studio plan. "We" and "us" means Stay Found Studio. "You" means the business signing up. By ticking the box and setting up your payment, you agree to these terms.
What we provide
We provide the services listed for your plan on our pricing page at the time you sign up. This can include designing and building your website, hosting, setting up and managing your Google Business Profile, online booking, review requests and replies, missed-call text-back, help with ads and a monthly results email, depending on your plan.
We'll agree the details of your website with you before it goes live, and we won't publish anything without your approval.
Your plan and minimum term
Every plan has a minimum term of 12 months from the date of your first payment. This is how we cover the cost of designing and building your website without charging an upfront fee.
After the minimum term, your plan continues month to month until you cancel.
Payment
Plans are paid monthly in advance, in Australian dollars, through PayPal. Your first payment is taken when you sign up, then on the same date each month.
If a payment fails, we'll let you know and give you 14 days to fix it. If it still isn't paid, we may pause your services until it is.
Costs paid to other companies, such as advertising spend, card processing fees or some booking tools, aren't included in your plan. We'll always tell you about these before they start.
We may change our prices with at least 30 days' written notice. Your price won't change during your minimum term.
Changing plans
You can move up a plan at any time, and the new price applies from your next payment. You can move down a plan after your minimum term, and the change applies from your next billing month.
Cancelling
After your minimum term, you can cancel at any time with 30 days' notice by emailing us.
If you cancel during your minimum term, the remaining monthly payments for that term are still due, unless we agree otherwise in writing.
Please email us before cancelling the payment in PayPal, so we can arrange the handover. Cancelling the payment in PayPal on its own doesn't end the agreement.
What's yours
Your web address is registered in your business's name. Your logo, photos, words and customer information always belong to you.
When you leave, we'll give you a copy of your website content and photos, help move your web address to whoever you choose, and make sure any booking or review accounts set up in your business's name stay with you. The design files and code we create remain ours unless we agree otherwise.
Your responsibilities
You're responsible for the accuracy of the information you give us, such as prices, opening hours and services, and for having the rights to any photos and logos you send us.
You agree not to ask us to publish anything misleading or unlawful. We never write or buy reviews, and we won't publish fake ones.
Results
We work hard to help you get found and get more bookings, but we can't guarantee a particular Google ranking, number of reviews or amount of new business.
Our liability
Nothing in these terms limits your rights under the Australian Consumer Law. Where the law allows, our total liability to you is limited to the fees you paid us in the 3 months before the problem arose, and we aren't liable for indirect losses such as lost profits.
Ending the agreement
Either of us can end the agreement straight away if the other seriously breaks these terms and doesn't fix the problem within 14 days of being asked.
General
We may update these terms from time to time. If a change affects you, we'll tell you at least 30 days before it applies.
These terms are governed by the laws of Queensland, Australia.
